Delara Darabi's letter to Nazanin Afshin-Jam

(Nazanin in Persian means dear, lovely and precious. Delara has used the word Nazanin with interchangable with its meanings in her letter to Nazanin Afshin-Jam)

Hello to precious, my unseen friend, Hi to my dear Nazanin
I thank and appreciate for all your honest and giving support. I don't know, I even don't know how this happened to me. After many years I still haven't been able for even few minutes resolve it. (I cant understand those few minutes!) Lets not get to it,...... It has been a while that I have been wanting to write you but my hands were not helping...

Dear Nazanin, you live there...you struggle and shout and ...I am here far away and all around me is filled with your letters, memories and hopes. Filled with kindness of all of you my unseen friends. Filled with your giving, lasting and pure kindness

My Lord! On the third bed of this cell , I am sitting in the corner of an accusation and I am writing to you... Kind Nazanin.
I hope for the day that I can meet all of you kind people in person and to see you with my own eyes, Because I have already have felt your purity, kindness and your vast love with my heart...

I wish God gives enough life to Delara that she can complete all her purposes...Dear Nazanin, you don’t know how difficult it is when one sees that friends and dear ones move on with life but you stay stagnant and in one place.My dear Nazanin, you don't know how painful it is to see (in here) freedom of those who are proud that they murdered someone but in their own court (conscious) they represent themselves as innocent and not guilty and they even give themselves the right for what they had done and...

Dear Nazanin, I don't know.... may be they are right, I am only afraid that I may not deserve so much blessing and attention from so many dear ones worldwide. I am afraid that I may not deserve all my pains. The sorrows, pains, insults, despise and falsifications that has become the meanings of my life...All the meaning of my life...

You are a human rights activist and you shout...and I quietly and with no sound, I present to your beautiful eyes , the same rights and pains ..with no judgments or words...In silence you have heard and are hearing my screams more clear and more beautiful don't you?!My heart has much to express but time is short and I am not allowed any control !!! Writing here is meaningless.Everything here is fake and superficial. This world is worthless but a world filled with missions.
I don't know if I will meet you my dear ones or we must leave the meeting to the the unseen world.Anyway, Delara is not alone, Delaras are trapped in prisons and in need of God's help and in need of defenders of human right and humanity!!!

I hope that you defend humanity and always be successful. The one who defends humanity and knowledge , is not a human but a true knower of God and knower of self. A reference, a gauge and a motive for life...and that is how you are ...Nazanin (precious) of all ages.

You and I and all of us, human beings of the world came here with will but after a while we forgot everything... We live with different feelings, with perplexity and amazements and we still do not understand why?

I cry a lot, just like the spring clouds! with large droplets...have you ever seen it?! Yes my cries are because when Iwas could have loved I had shortcomings and now that I am loved, my hands are tight from everywhere an everyone.I have never cried for being imprisoned, because my thoughts and my heart is free and is with you : the best

! آنکه نادیده و نشناخته .....با دل آرا همدردی نمود
خدایا به نام تو سلام به نازنین یار نادیده ام،
سلام به نازنین عزیزم...از تمامی حمایت های بی دریغ و بی ریا
و شاید بی دیللتان ممنون و سپاسگذارم،نمی دانم،خودم هم نمی دانم چطور این اتفاق برایم افتاد،بعد سالها هنوز نتوانستم آن چند دقیقه را برای خودم حلاجی کنم!بگذریم،مدتها بود که می خواستم برایت بنویسم ولی دستهایم یاری نمی کرد...
نازنین جان تو در آنجایی و زندگی می کنی...تلاش می کنی و فریاد میزنی و...من اینجایم و دو ر تا دو رم از نامه ها وخاطره ها و امید های شما پر است،از محبت های شما دوستان نادیده ام،از لطف بی دریغ و همیشگی وپاک خدایم ! روی تخت سوم در کنج یک اتهام نشسته ام و برای تو نازنین مهربان می نویسم.آرزوی روزی را می کنم که همه شما مهربانان را از نزدیک و این دو چشم ملموس خود ببینم، چون پاکی و محبت و عشق ماورای شماها را قبلاًباچشمان دلم لمس کرده ام...امیدوارم خداوند آنقدر عمر به دل آرا بدهد تا تمام رسا لت هایش را بتوانہ f ب_e5 اتمام برساند..
.نازنین جان نمی دانی چقدر سخت است سالها رفتن دوستان و عزیزانت را ببینی و خودت در سکون غرق شده باشی و هی در جا بزنی!!! نازنینم نمی دانی چقدر دردناک است آزادی کسی راببینی که بارها و بارها از خود به خاطر قتلی که کرده تشکر کرده ودر دادگاه شخصی خود ،خود را بیگناه و تبرئه نموده و حتی حق خود دانسته که این کار را باید انجام می داده و...نازنین جان نمی دانم شاید حق با آنها باشد ،من تنها از این می ترسم که لیاقت این همه لطف خداوند و توجه عزیزانم در سراسر دنیا را نداشته شم، ترسم از این است که لیاقت رنجهایم را نداشته باشم، همان رنجها ودردها و توهین ها وتحقیر ها و حق و نا حق کردنها که معنای زندگی ام شده اند...
تمام معنای زندگی ام ...تو فعال حقوق بشری و فریاد می زنی! ومن آرام و بی صدا همان حق ها ودردها را به نگاه زیبای شما تقدیم میکنم، بی هیچ قضاوت یا حرفی....در سکوت فریاد ها را زیباتر وشیواتر میشنوید وشنیدید...مگر نه؟!خلاصه حرف دل بسیار است و وقت کم واختیار بی اختیار!!!اینجا نوشتن معنا ندارد، اینجا همه چیز فرمالیته و ظاهریست.
نمی دانم من در این دنیای بی ارزش ولی پررسالت شما دلبندانم را ملاقات خواهم کرد یا وعدهء مان به دنیایی نادیده موکول شود، در هر حال دل آرا تنها نیست ،دل آرا هایی در زندانها اسیرند که محتاج کمک خدا و حما یت حامیان انسانیت و بشریت اند!!!امیدوارم از انسانیت دفاع کنی وهمیشه موفق باشی ؛آنکه از انسانیت ومعرفت دفاع می کند،انسان نیست یک خدا شناس ِخود شناس ِتمام عیار است ،یک ملاک و معیار و انگیزه برای زندگی است...
و تو نازنین تمام اعصار اینچنینی!!!من و تو و همه ی ما انسانهای دنیا با ا راده به دنیا آمده ایم ،بعد از مدتی همه چیز یادمان رفت....با
حیرت و شگفتی و احساسهای دیگر زندگی می کنیم و باز نمی فهمیم چرا؟...
و آخر هم با حسرت از تعدادمان روی کره خاکی کم و کمتر میشود و باز هم نمی فهمیم چرا؟!!من گریه زیاد می کنم، درست مثل ابر بهاری !با قطره های درشت...تا حالا دیده ای؟! آری گریه ام به خاطر این است که آن زمان که باید دوست می داشتم ، کوتاهی کردم و حالا که دوستم دارند ، دستم از همه جا و همه کس کوتاه شده است ،هرگز برای در بند بودن نگریسته ام زیرا که اندیشه وقلبم آزاد است و پیش شما بهترینها...
دل آ را 86/2/18 سلام مرا به همه ی دوستداران ِواقعی ام برسان

چون من هر شب سر نماز برای تمام انسانهای این خانه ی بزرگِ بی در و پیکر دعا میکنم ! دعا می کنم که روزی همگی عاشق هم باشیم وبا هم روی سفره با وسعت ِخدا میهمان باشیم!want to know ,that s you are ,wait for me untill the day i am not prison here!

Craintes d'exécution imminente de Delara Darabi, une “délinquante mineure”.


IRAN: C’est par facebook que j’ai pris connaissance de cette histoire; histoire qui fait froid dans le dos.
Etudiant à l’étranger j’ai parmis mes contacts des étudiants des quatre coins du monde et c’est le statut, dès très tôt hier matin, d’un ami Iranien qui m’interpella: “PROTEST LOUDLY: Delara Darabi is scheduled to be executed in less than 3days!»«Protestez bruyamment: l’execution de Delara Darabi est prévue pour dans moins de 3 jours!”Le nom ainsi que les événements qui l’entourent m’étant encore inconnus j’ai de suite cherché à en savoir plus.Delara Darabi est alors âgée de 17 ans quand, en 2003, accompagnée de son petit ami, âgé lui de 19 ans, elle cambriole la maison de la cousine de son père.
Le cambriolage change alors de ton lorsque cette dernière est tuée, prétendument par Amir Hossein Sotoudeh. Afin de protéger son compagnon d’une forte possible execution, Delara Darabi confesse dans un premier avoir commis le crime, avant de se retracter par la suite.
Celle ci fut condamnée à mort en février 2005; sa vie n'est alors depuis qu'un amer mélange de doute, peur, incertitude. Son ami,lui, ayant été condamné à 10 ans d'emprisonnement pour complicité de meurtre.Amnesty International propose un résumé de toute l'histoire (http://www.amnesty.org/en/library/asset/MDE13/031/2009/en/095de103-015d-431d-9b3e-1406b8edd8ef/mde130312009fra.html), son déroulement, ainsi que des informations générales sur les exécutions de mineurs en Iran:Depuis 1990, l'Iran a exécuté au moins 42mineurs délinquants, dont huit en 2008 et un le 21janvier 2009.«L'exécution de mineurs délinquants est interdite par le droit international, en particulier par l'article6-5 du Pacte international relatif aux droits civils et politiques (PIDCP) et par la Convention relative aux droits de l'enfant.
En tant que partie à ces deux traités, l'Iran s'est engagé à ne pas exécuter de personnes pour des crimes commis alors qu'elles avaient moins de dix-huit ans.En Iran, une personne reconnue coupable de meurtre n'est pas autorisée à demander une grâce ou une commutation à l'État, en violation de l'article 6-4 du PIDCP. Dans ce pays, la famille d'une victime d'homicide a le choix entre exiger l'exécution de l'accusé ou lui pardonner, en échange d'une compensation financière, la diya.»Omid, ce même ami, contact de facebook, a passé la journée de hier à poster vidéos, articles, photos, témoignages, à créer groupes de soutiens etc. en vue d'alarmer la population (principalement iranienne) de la situation.
Eveiller les consciences et dénoncer à travers internet est chose commune en Iran, plus de 20 000 Iraniens résidant à l'étranger sont enregistrés sur facebook, et le pays même compte environ 2,5 millions de blogs, le plaçant alors après les Etats Unis et la Chine dans le “top des blogsphères”.Une preuve que les Iraniens, avec leur histoire riche et tragique, ne cessent de “protester bruyamment”; et si les rues iraniennes ne sont pas propices à cela, les claviers eux sont là pour mettre des mots sur les maux de cette même société qui ne cesse de penser, s'exprimer et alors protester.

Delara Darabi's lawyer, Abdolsamad Khorramshahi, fears that his client is at imminent risk of being executed. This follows a telephone call he received from Delara Darabi on 21 March 2009 in which she said that she had heard rumours in Rasht Prison that she would be executed. Delara Darabi's lawyer, Abdolsamad Khorramshahi, fears that his client is at imminent risk of being executed. This follows a telephone call he received from Delara Darabi on 21 March in which she said that she had heard rumours in Rasht Prison that she would be executed. Delara Darabi has been detained at Rasht Prison, in northern Iran since her arrest in 2003 and sentenced to death for murder for a crime she committed when she was 17.
Normal legal avenues in her case have been exhausted, though domestic and international concerns about her situation appear to have resulted in repeated and slow-moving legal reviews. To ensure that she will not be executed however, all the members of the victim’s family must agree to accept diyeh, or payment, sometimes called ‘blood money’ in exchange for her pardon. One relative is said to be undecided as to his wishes.
In September 2003, a then 17-year old Delara Darabi and her 19-year-old boyfriend Amir Hossein Sotoudeh broke into her father’s 58-year-old female cousin Mahin’s house to commit a burglary. Amir Hossein allegedly killed the woman during the burglary. Delara Darabi initially confessed to the murder in order to protect her boyfriend from execution, claiming that he had told her that as she was 17 she could not be executed. She subsequently retracted her confession.
Delara Darabi was initially sentenced to death by Branch 10 of the General Court in Rasht on 27 February 2005. In January 2006, the Supreme Court found "deficiencies" in the case and sent it to a children’s court in Rasht for retrial. Following two trial sessions in January and June 2006, Delara Darabi was sentenced to death for a second time by Branch 107 of the General Court in Rasht. Amir Hossein Sotoudeh was sentenced to 10 years’ imprisonment for complicity in the murder. Both received sentences of three years’ imprisonment and 50 lashes for robbery, and 20 lashes for an "illicit relationship". Delara Darabi’s death sentence was upheld by the Supreme Court on 16 January 2007.
In March 2007, her lawyer filed an appeal against her death sentence. In April 2007 her death sentence was confirmed following a further review by Branch 7 of the Supreme Court, after which the verdict was sent to the Head of the Judiciary for consideration. In December 2007, as a result of procedural flaws having been identified, the Head of Judiciary reportedly returned the case to Rasht for a further review. In February 2008, human rights lawyer Mohammad Mostafaie was reported to have visited Delara Darabi in prison. She was said to be very depressed and told Mohammad Mostafaie that she was tired of the waiting and of her unbearable life in prison. BACKGROUND INFORMATION
Iran has executed at least 42 juvenile offenders since 1990, eight of them in 2008 and one on 21 January 2009.
The execution of juvenile offenders is prohibited under international law, as stated in Article 6(5) of the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), to which Iran is a state party, and so has undertaken not to execute anyone for crimes committed when they were under 18.
In Iran a person convicted of murder has no right to seek pardon or commutation from the state, in violation of Article 6(4) of the ICCPR. The family of a murder victim have the right either to insist on execution, or to pardon the killer and receive financial compensation (diyeh).

RECOMMENDED ACTION: Please send appeals to arrive as quickly as possible, in Persian, Arabic, English or your own language:
- expressing great concern at reports that Delara Darabimay be at imminent risk of execution for a crime committed when she was under 18;
- calling for re-trial of the case in proceedings meeting international standards for fair trial and in line with the Convention of the Rights of the Child, to which Iran is a state party:
- urging the Iranian authorities to commute her death sentence;
- reminding the authorities that Iran is a state party to the International Covenant on Civil and Political Rights (ICCPR) and the Convention on the Rights of the Child (CRC), which prohibit the use of the death penalty against people convicted of crimes committed when they were under 18.

اعدام دلارا دارابی، اعدام یک کودک است

دلارا دارابی به خاطر جرمی که در 17 سالگی مرتب شده به اعدام محکوم و قرار است پس از 6 سال زندان در سن 23 سالگی، چهار روز دیگر، به دار آویخته شود.
بر اساس پیمان‌نامه جهانی حقوق کودکان ، اعدام کودکان زیر 18 سال ممنوع است اما دادگاه های ایران با صدور احکام اعدام ، تا زمان رسیدن این افراد به سن بالای 18 سال صبر نموده و پس از آن احکام را اجرا می کنند.
این در حالی است که اینگونه برخورد با قانون منع اعدام کودکان زیر 18 سال به نوعی کلاه شرعی محسوب شده و دور زدن این قانون بین المللی است. اعدام دلارا ، اعدام زنی 23 ساله نیست بلکه اعدام او در سن 17 سالگی است.
باید تلاش نمود با فشار به مراجع مسوول و جایگزین نمودن مجازاتهای دیگر برای جرائم اینچنینی ، اعدام کودکان در ایران را متوقف کرد.
رادیو زمانه: دل‌آرا دارابی، زن ۲۳ ساله‌ای که از شش سال پیش به اتهام قتل در زندان به سر می‌برد، چهار روز دیگر اعدام می‌شود.
پدر دل‌آرا دارابی نیز در نامه‌ای به رئیس قوه قضائیه، نوشته‌است: «شش سال است که در کابوس مرگ و زندگی دخترم زندگی می‌کنم. جناب آقای شاهرودی، در عذاب اعدام یک دختر ۲۳ساله زندگی کردن کار بسیار دشواری است.» [بیشتر]
